Inmate pleads guilty to sodomy charge

A registered sex offender pleaded guilty Tuesday in a Callaway County courtroom to sodomizing a fellow prisoner a year ago.

James Robert Gibson, 28, previously of Jefferson City, pleaded guilty to second-degree sodomy in the Circuit Court of Callaway County, Division I, with Judge Brouck Jacobs presiding.

According to the Callaway County Prosecutor's office, Gibson admitted he sodomized an inmate at the Fulton Reception and Diagnostic Center in February 2017 while the two men were incarcerated at that institution. The victim reported Gibson threatened to physically assault him if he did not submit to the sexual contact, according to the Callaway County Prosecutors Office.

Gibson admitted to the judge the victim had not consented to the act. The judge sentenced Gibson to seven years in prison to be served consecutively to the 10-year sentence he is currently serving for child molestation from Cole County. The case was investigated by the Missouri Department of Corrections.

On June 26, 2007, Gibson was charged with first-degree child molestation and first-degree statutory sodomy/deviant sexual intercourse with a person less than 14 years old, a felony. According to the Missouri State Highway Patrol's Sex Offender Registry, Gibson was aged 18 when he assaulted a 9-year-old boy in Jefferson City.

He entered guilty pleas the following year and was sentenced to 10 years of incarcertation.

Other cases heard Tuesday include:

Scott Allen, 53, of Williamsburg, was sentenced to three years in prison for unlawful possession of a firearm by a convicted felon. Allen had been on probation for the offense, admitted violating probation, and the judge revoked it. The case was originally investigated by the Callaway County Sheriff's Office.

Robert Erik Bishop, 50, of Columbia, failed to appear in court. A warrant was issued for his arrest.

Michael Branch, Jr., 31, of Kansas City, was sentenced to five years in prison for second-degree domestic assault. Branch had been on probation for the offense, admitted violating probation, and the judge revoked it. The case was originally investigated by the Holts Summit Police Department.

Patrick Frolick, 60, of Lake Saint Louis, pleaded guilty to three counts of forgery. Frolick admitted he completed purchase order invoices on three separate occasions in February 2015 so that the invoices purported to have been made by customers of his employer. Those customers had not approved the purchases. Frolick admitted the forgeries were committed to defraud his employer into paying him commissions for the fictitious sales. The judge placed Frolick on five years of supervised probation under several conditions, including that he pay over $43,000 in restitution to the victim. The case was investigated by the Callaway County Sheriff's Office.

Michael Graham, 34, of Fenton, pleaded guilty to possession of a controlled substance (tetrahydrocannabinol, commonly known as THC) and leaving the scene of a motor vehicle accident. Graham admitted he was the driver of a vehicle that crashed on Interstate 70 in July 2016. The crash damaged cables and stakes in the median and a passenger in Graham's vehicle was slightly injured. Graham then fled the crash scene on foot before being apprehended. During the investigation, troopers located THC edibles and beverages in Graham's vehicle and Graham admitted the drugs were his. The judge sentenced Graham to six years in prison for the drug charge and four years in prison for leaving the scene of an accident. In addition, the judge ordered Graham to pay restitution for the damages. The case was investigated by the Missouri State Highway Patrol.

Charles McDonald, 37, of Fulton, pleaded guilty to second-degree burglary and misdemeanor stealing. McDonald admitted he burglarized a residence on County Road 184 last November and stole a mini-motorcycle, radio and ladder. The judge sentenced McDonald to four years in prison for the burglary offense but suspended execution of that sentence and placed him on five years of supervised probation under several conditions, including that he pay restitution to the victim. The judge sentenced McDonald to 10 days in jail for the stealing offense. The case was investigated by the Callaway County Sheriff's Office.

Mark Stanley, 44, of Bolivar, pleaded guilty to possession of a controlled substance (methamphetamine) and was sentenced to four years in prison. Stanley admitted he possessed the drug last September when he was arrested on an unrelated warrant. The case was investigated by the Holts Summit Police Department.

Samuel Weyland, 20, of New Bloomfield, pleaded guilty to two counts of forgery and was sentenced to three years in prison on each charge. Weyland admitted last September he forged and cashed two checks belonging to a Jefferson City couple who allowed Weyland to stay in their home. The judge suspended execution of the prison sentences and placed Weyland on five years of supervised probation under several conditions, including that Weyland pay restitution to the victims. The case was investigated by the Holts Summit Police Department.

William Winter, 53, of Altamont, Kansas, pleaded guilty to escape from commitment and was sentenced to three years in prison. Winter admitted he had been committed to the care of Department of Mental Health in 2007 by the Circuit Court of Vernon County after he was found not guilty by reason of mental disease or defect on charges of robbery and armed criminal action. Winter further admitted he was on conditional release from Fulton State Hospital in December 2014 when he fled to Kansas. Winter was apprehended by Kansas authorities and returned to Missouri last year. The case was investigated by the Missouri Department of Mental Health and Fulton Police Department.
