Eldon man sentenced to 10 years in prison after violating probation

An Eldon man was sentenced to 10 years in prison Oct. 6 after violating his probation. 

According to Miller County Prosecuting Attorney Benjamin Winfrey,  Robert J. Cody Jr. of Eldon was sent to the Missouri Department of Corrections for 10 years after a probation violation hearing in the Miller County Circuit Court.

Cody was on probation for two felony counts of second degree burglary, in which he pleaded guilty to in 2014. Cody was sentenced to 10 years in prison on each county, but the sentences were suspended and he was placed on a five-year term of probation, Winfrey said.

Cody was ordered to pay restitution in excess of $18,000 to his burglary victims. During the course of his probation, Cody was accused of probation violations such as burglary, domestic assault, arson and possession of a firearm, Winfrey said. He also allegedly never paid his victims during the probation.

"We take probation seriously in this county, and we will strive to prevent its abuse," Winfrey said.

As always, Winfrey and the Miller County Prosecuting Attorney's Office thank law enforcement for helping resolve this case. Winfrey said all defendants are presumed innocent until proven guilty, and a criminal charge is not proof of guilt.
